Please read these Terms & Conditions carefully before booking a session with Smart in the Outdoors ("we", "us", "our"). By booking a session or creating a member account, you agree to be bound by them.

These Terms & Conditions should be read alongside our Privacy Policy and Refund Policy, which form part of your agreement with us.

1. About Us

Smart in the Outdoors runs outdoor events including yoga, guided hikes, foraging walks, and retreats.

2. Bookings

  • Bookings are made through our website and are confirmed once payment has been received.

  • You must provide accurate information when booking, including your contact details, emergency contact, and health/dietary information via our medical questionnaire.

  • Places on sessions are limited and allocated on a first-come, first-served basis.

  • Members may view their booking history and rebook using saved details via their member account; one-off (guest) bookings are also available.

3. Eligibility & Health Declaration

  • Our sessions are physical in nature and take place outdoors, sometimes on uneven or remote terrain.

  • You must complete our medical questionnaire honestly and in full before attending any session, and keep it up to date. It is your responsibility to notify us of any change to your health, fitness, medication, or dietary needs.

  • By booking, you confirm that you are fit and able to participate in the session booked, or have disclosed anything that might affect this.

  • We reserve the right to refuse participation, at our discretion, if we reasonably believe a session would be unsafe for you based on the information provided.

4. Assumption of Risk

Outdoor physical activity carries inherent risks, including but not limited to uneven terrain, weather conditions, physical exertion, and (where relevant) exposure to plants, insects, or wild foraged food. By booking, you acknowledge these risks and voluntarily choose to participate. We will take reasonable care to run sessions safely, but we cannot eliminate all risk associated with outdoor activity.

5. Cancellations, Refunds & Transfers

All bookings are subject to our Refund Policy, which explains that bookings are non-refundable and that transfers are considered entirely at the Director's discretion.

6. Weather & Session Changes

Some sessions may be affected by weather or other circumstances outside our control. Where this happens:

  • We may adapt, postpone, or relocate a session for safety reasons

  • We will let you know as soon as reasonably possible

  • Where we cancel a session entirely, our Refund Policy applies

7. Photography & Media

We may take photographs or video during sessions for use in our marketing, website, or social media. If you do not wish to be photographed or featured, please let us know in advance and we will do our reasonable best to accommodate this.

8. Liability

  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for anything else which cannot legally be excluded or limited.

  • Subject to the above, we are not liable for any loss, injury, or damage arising from your participation in a session, except where caused by our negligence or breach of these Terms.

  • We recommend you hold your own appropriate insurance (e.g. personal accident or travel insurance) where relevant, particularly for multi-day retreats.

9. Your Personal Information

Any personal and health information you provide is handled in accordance with our Privacy Policy, including how we store, use, and protect your data, and your rights regarding it.

10. Code of Conduct

We ask all participants to treat instructors, staff, and fellow participants with respect. We reserve the right to remove any participant from a session, without refund, whose behaviour is disruptive, unsafe, or inappropriate.

11. Intellectual Property

All content on our website, including text, images, and branding, belongs to Smart in the Outdoors and may not be copied or reused without our permission.

12. Changes to These Terms

We may update these Terms & Conditions from time to time. The "last updated" date at the top will reflect the most recent version. Continued use of our website or services after changes are published means you accept the updated Terms.

13. Complaints

If you have a complaint about a session or our service, please contact us at info@smartintheoutdoors.com and we will do our best to resolve it promptly.

14. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
